“YES”on H.R. 2250, the EPA Regulatory Relief Act.

NTU urges all Representatives to vote“YES” on H.R. 2250, the EPA Regulatory Relief Act. Introduced by Rep. Griffith(R-VA), this bipartisan bill grants the Environmental Protection Agency (EPA) additionaltime to develop achievable, prudent rules to govern emissions from non-utilityboilers and incinerators.

H.R.2250 responds to the EPA’s rushed regulatory processes, which resulted in overlyburdensome strictures that could have tremendously negative impacts onbusinesses. In formulating the Maximum Achievable Control Technology (MACT)standards for boilers, the EPA calculated emissions levels on each type ofpollutant, rather than the aggregate. As a result, none of the best-performingboilers could achieve the new standards, forcing the EPA to admit its failureto “calculate standards that fully reflected operational reality.” This and ahost of other technical and statutory errors led the EPA to seek court approvalto extend the deadline for issuing rules, a petition thatwas ultimately denied.

H.R.2250 would provide the EPA with 15 months to re-propose and finalize new rulesas well as extend compliance deadlines from 3 to at least 5 years. Such common-sensemeasures will allow the EPA the latitude necessary to formulate workable rules andprovide businesses a measure of certainty – a win-win for taxpayers and theeconomy.

Roll call votes on theEPA Regulatory Relief Act will be significantly weighted in our annualRating of Congress and a “YES” vote will be considered the pro-taxpayerposition.
