NTU urges all Representatives to vote“YES” on H.R. 3094, the “Workforce Democracy and Fairness Act.” Introduced byRep. Kline (R-MN), this bill would preempt the National Labor Relations Board’s(NLRB’s) proposed rulemaking that would substantially change the proceduresused to govern union elections concerning representation.

While streamlining procedures and utilizing moderntechnology to avoid undue delay in the representation process are laudablegoals, the NLRB’s proposed rulemaking threatens to upset an important balanceof rights among all parties in that process. Such a balance ultimately hasimplications for our entire free-market economy. By substantially shorteningthe time between the filing of the petition and election date, and severelylimiting employers’ ability to engage in an evidentiary hearing on contestedissues, the NLRB’s rule could undermine workers’ ability to accurately weigharguments for and against unionizing. In anticipation of this rule, H.R. 3094would set minimum and maximum time frames in which action must be taken in responseto an election petition. As a result, workers would have the time and resourcesthey need to make an informed choice.

Roll call votes onH.R. 3094 will be significantly weighted in our annual Rating ofCongress and a “YES” vote will be considered the pro-taxpayer position.
